These Terms of Service ("Terms") govern your use of Profiling.app (the "Service"). By creating an account, by clicking to accept these Terms, or by using the Service, you agree to them. If you do not agree, do not use the Service.
The Service is operated by Tamás Szigeti, an individual entrepreneur (egyéni vállalkozó) registered in Hungary ("we", "us", "our", the "Operator"), registered seat at 2484 Gárdony, Mikszáth Kálmán utca 29., Hungary, tax number HU22141239. Contact: privacy@profiling.app.
The capitalised terms below carry these meanings throughout these Terms.
You must be at least 18 to use the Service. You are responsible for activity under your account and for keeping your sign-in details secure. You may authenticate by password, Google sign-in, or email sign-in link. You agree to provide an email address you control.
You agree to these Terms when you create your account ("By continuing, you agree…"). Your acceptance is recorded.
The Service turns a Respondent's questionnaire answers into a 10×10 matrix mapping their preferences across the ten phases of the Holigral model, and provides a written Evaluation interpreting that matrix. Individual answers remain internal and are not shown to the commissioning Workspace; the Workspace and the Respondent may see the matrix and the Evaluation.
The Evaluation is interpretive and supportive. It is not advice, not a diagnosis, not a recommendation, and not a decision. It does not assess anyone's fitness for employment, and it must not be treated as doing so. Any decision taken in reliance on it is the decider's own.

We may suspend or terminate access for breach of this section, and for serious breach without notice.
This section is important. Where you commission a profile of another person, you have the relationship with that person; we do not.
You warrant (that is, you promise us, and we rely on your promise) that, for every Respondent you cause to be profiled:
a. you have a lawful basis under data-protection law to have them profiled; b. you have given them whatever privacy notice or information the law requires, and obtained any consent the law requires; c. you will not use the matrix or Evaluation as the sole basis for any decision producing legal or similarly significant effects on them, and you accept that any decision you take is yours alone; and d. you will respond to any request they make to you as the Controller of their profiling data, with our assistance in exporting or deleting that data.
Where you profile yourself, these warranties are satisfied by the fact that you are the subject and you are consenting to your own profiling; they impose nothing further on you.
You will indemnify us against claims, losses, and costs arising from your breach of this section — in particular, claims by a Respondent that they were profiled without a lawful basis or without proper notice.
How we handle personal data is set out in our Privacy Policy. Where we process profiling data on behalf of your Workspace, we do so as your processor under the Data Processing Agreement, which you accept when your Workspace is created and which forms part of these Terms.
Unspent Credits are refundable for 14 days after purchase. If, within 14 days of buying Credits, you have not yet committed them to a profiling (see §9.2) and you ask us to refund the unused balance, we will refund it to your original payment method. Contact us at privacy@profiling.app. After 14 days, unspent Credits remain usable and do not expire, but are no longer refundable.
A Credit is committed at Assignment creation — the moment a profiling is set in motion: when you send an invitation to a Respondent, or when you begin a self-profiling. Committing a Credit starts the service.
Once a Credit is committed, it is not refundable as money, because performance of the service has begun. The Credit mechanics in §8 still govern the movement of Credits between commitment and completion — in particular, a Credit is returned to your balance (as a Credit, not as money) if the Assignment is revoked before the Respondent submits. We may, at our discretion and as a goodwill matter, return a committed Credit in other circumstances, but we are not obliged to, and this does not create any entitlement to a monetary refund.
If you are a consumer (a person acting outside a trade, business, or profession), you ordinarily have a 14-day right to withdraw from a distance contract for a service.
Business customers acting in the course of a business have no consumer right of withdrawal; §§9.1–9.2 govern their Credits in any event.
The Service, the questionnaire catalogue, the matrix mathematics, the Holigral model as expressed in the Service, and all related materials are our intellectual property or licensed to us. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You acquire no rights in our intellectual property. The content of your own Submissions and the Evaluations commissioned for your Workspace belong to you / your Workspace as between us; we hold them as described in the Privacy Policy and DPA.
We aim to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features. We may change these Terms; on a material change we will update the "Last updated" date and, where appropriate, notify you. Continued use after a change means you accept it.
The Service is provided "as is". To the fullest extent permitted by law, we disclaim all implied warranties. We make no representation that any Evaluation is accurate, complete, or fit for any particular decision. The Holigral model is an interpretive framework; outputs are interpretive, not factual measurements of a person's worth, ability, or character.
Nothing in these Terms excludes liability that cannot lawfully be excluded — including, for consumers, your mandatory statutory rights under Hungarian and EU law, which these Terms do not affect.
To the fullest extent permitted by law, and except for liability that cannot lawfully be limited:
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach of these Terms. On termination, the provisions that by their nature should survive — including §§6, 9, 10, 12, 13 and 15 — survive. Unused Credits are not refunded on termination for your breach; otherwise we will deal with unused Credits reasonably and in good faith.
These Terms are governed by the laws of Hungary. The courts of Budapest, Hungary have jurisdiction over any dispute, except that, if you are a consumer, you keep the benefit of any mandatory protections and any right to bring proceedings in the courts of your place of residence that the law gives you.
